Terms of Service

Welcome to SokoHero ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the SokoHero platform, including our website, mobile applications, and related services (collectively, the "Platform").

By accessing or using our Platform, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Platform. These Terms constitute a legally binding agreement between you and SokoHero.

SokoHero is a car marketplace platform that connects buyers and sellers of vehicles in Kenya. We provide a platform for users to list, browse, and communicate about vehicles, but we are not a party to any transactions between users.

"User" or "You"

Any person who accesses or uses the Platform, including buyers and sellers.

"Seller"

A User who lists a vehicle for sale on the Platform.

"Buyer"

A User who browses, views, or expresses interest in purchasing a vehicle listed on the Platform.

"Listing"

A vehicle advertisement posted on the Platform by a Seller.

"Platform"

The SokoHero website, mobile applications, and all related services and features.

"Content"

Any information, text, images, photos, videos, or other materials posted on the Platform.

"Transaction"

Any sale, purchase, or exchange of a vehicle between Users facilitated through the Platform.

3.1 Account Registration

To use certain features of the Platform, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

3.2 Age Requirements

You must be at least 18 years old to create an account and use the Platform. By creating an account, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

3.3 Account Responsibility

You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree not to share your account credentials with any third party.

4.1 Eligible Vehicles

You may only list vehicles that you own or have the legal authority to sell. All vehicles must be:

• Legally registered and roadworthy (if applicable)
• Accurately described with correct information
• Accompanied by clear, accurate photographs
• Priced fairly and transparently

4.2 Prohibited Listings

You may not list:

• Stolen vehicles or vehicles with fraudulent documentation
• Vehicles that are not legally yours to sell
• Vehicles with false or misleading information
• Duplicate listings for the same vehicle
• Vehicles that violate any applicable laws or regulations

4.3 Listing Accuracy

All information in your listings must be accurate, complete, and truthful. You must disclose any known defects, accidents, or issues with the vehicle. Misleading or false information may result in immediate removal of your listing and termination of your account.

As a Seller, you agree to:

• Provide accurate and complete information about the vehicle
• Upload clear, high-quality photos that accurately represent the vehicle
• Respond promptly to inquiries from potential buyers
• Disclose any known defects, accidents, or mechanical issues
• Provide all necessary documentation (logbook, ownership documents, etc.)
• Complete transactions in good faith
• Remove listings promptly after a vehicle is sold
• Comply with all applicable laws and regulations regarding vehicle sales

As a Buyer, you agree to:

• Conduct your own due diligence before purchasing any vehicle
• Verify the vehicle's condition, documentation, and ownership
• Inspect the vehicle in person before completing a purchase
• Verify all documentation (logbook, ownership, insurance, etc.)
• Complete transactions in good faith
• Use safe payment methods and meet in safe locations when viewing vehicles
• Report any suspicious listings or fraudulent activity to SokoHero

Important: SokoHero does not verify the accuracy of listings or the identity of sellers. You are responsible for verifying all information before making a purchase.

7.1 Transaction Handling

SokoHero is a platform that facilitates connections between buyers and sellers. We are not a party to any transactions between users. All transactions are conducted directly between buyers and sellers.

7.2 Payment Methods

Buyers and sellers are responsible for agreeing on payment methods. SokoHero does not process payments or hold funds. We recommend using secure payment methods and meeting in safe, public locations for transactions.

7.3 Fees

SokoHero may charge fees for certain services, such as featured listings or promotional packages. Any applicable fees will be clearly disclosed before you commit to a service. Basic listing and browsing are free.

7.4 Refunds

Refunds for SokoHero services (if applicable) are subject to our refund policy. Vehicle purchase refunds are matters to be resolved directly between buyers and sellers, as SokoHero is not a party to vehicle transactions.

8.1 Platform Content

All content on the Platform, including text, graphics, logos, icons, images, and software, is the property of SokoHero or its content suppliers and is protected by Kenyan and international copyright laws.

8.2 User-Generated Content

By posting content on the Platform, you grant SokoHero a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display your content for the purpose of operating and promoting the Platform.

8.3 Trademarks

"SokoHero" and related marks are trademarks of SokoHero. You may not use our trademarks without our prior written consent.

You agree not to:

• Post false, misleading, or fraudulent information
• List stolen vehicles or vehicles with fraudulent documentation
• Harass, threaten, or abuse other users
• Spam or send unsolicited messages
• Use the Platform for any illegal purpose
• Attempt to gain unauthorized access to the Platform
• Interfere with or disrupt the Platform's operation
• Copy, modify, or distribute Platform content without permission
• Use automated systems to access the Platform without authorization
• Impersonate any person or entity
• Violate any applicable laws or regulations

SokoHero is a platform that connects buyers and sellers. We are not a party to any transactions between users. We do not:

• Own, sell, or purchase vehicles listed on the Platform
• Verify the accuracy of listings or the identity of users
• Guarantee the condition, quality, or legality of vehicles
• Process payments or hold funds
• Provide warranties or guarantees for vehicles
• Mediate disputes between buyers and sellers

Users are solely responsible for their interactions and transactions. SokoHero acts solely as a platform provider.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SOKOHERO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the Platform
• Any transactions or interactions between users
• Any errors or omissions in Platform content
• Any unauthorized access to or use of our servers or data
• Any interruption or cessation of transmission to or from the Platform

SokoHero's total liability to you for all claims arising from or related to the Platform shall not exceed the amount you paid to SokoHero in the 12 months preceding the claim, or KES 1,000, whichever is greater.

You agree to indemnify, defend, and hold harmless SokoHero, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with:

• Your use of the Platform
• Your violation of these Terms
• Your violation of any rights of another user or third party
• Any content you post on the Platform
• Any transactions you enter into through the Platform

13.1 Termination by You

You may terminate your account at any time by contacting us or using the account deletion feature in your settings.

13.2 Termination by Us

We may suspend or terminate your account immediately, without prior notice, if you violate these Terms or engage in any fraudulent, illegal, or harmful activity. We reserve the right to remove any content or listings that violate these Terms.

13.3 Effect of Termination

Upon termination, your right to use the Platform will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts of Kenya.

If you are a consumer, nothing in these Terms affects your statutory rights under Kenyan consumer protection laws.

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on the Platform and updating the "Last Updated" date. Your continued use of the Platform after such changes constitutes your acceptance of the modified Terms.

If you do not agree to the modified Terms, you must stop using the Platform and may terminate your account.
